An Indiana commercial applicator applies a restricted-use pesticide. When is the use record created, and how long is it kept?
- Write it on the application date, and keep it for at least two years.
- Write it within 30 days, and keep it for one year.
- Write it only if the customer requests a copy, and keep it for three years.
- Write it before the application, and keep it for five years.
Create the restricted-use record on the application date and keep it at least two years.
Thirty days is the copy deadline, not the deadline to write the record.
You write the record even when the customer never asks for a copy.
This section sets two years of retention, not five.
355 IAC 4-4-1(e)A customer asks an Indiana commercial applicator for a copy of the restricted-use application record. When does the rule say to provide it?
- Within 30 days after the customer asks, even if that request comes much later.
- At the next license renewal, together with the rest of the year's records.
- Within 30 days of the application date, if the customer has asked for a copy.
- Anytime within the two-year retention period is soon enough.
If the customer asks, send the copy within 30 days of the application date.
The 30 days are counted from the application, not from the request.
License renewal is not the deadline for a customer's copy.
Two years is how long you keep the record, not how long you may delay the copy.
